Card Stash Terms of Service

Introduction

Welcome to Card Stash (the "Site"). Card Stash is a gallery-style trading card platform that allows users to showcase and browse trading card collections (similar to a social media gallery). By accessing or using Card Stash, you agree to these Terms of Service ("Terms") in full. If you do not agree, please do not use the Site. These Terms govern your use of Card Stash and form a binding agreement between you and the operators of Card Stash. The Site is intended for showcasing trading card collections (anime, fantasy, cartoon-themed cards, etc.) and is not a trading or e-commerce platform. Any use of the Site for buying, selling, or trading cards is discouraged and entirely at your own risk. We reserve the right to update or modify these Terms at any time by posting the revised Terms on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

User Eligibility

Card Stash is only for users aged 13 years and older. By registering or using the Site, you represent that you are at least 13 years of age. Users under 13 are not permitted to create an account or use cardstash.uk. If we discover or have reason to believe that any user is under 13, we will terminate the account. If you are between 13 and 18 (or the age of majority in your jurisdiction), you should use the Site under the supervision of a parent or guardian who consents to these Terms. Card Stash is offered only for personal, non-commercial use by eligible individuals. You may not use the Site if we have previously banned you or otherwise terminated your account.

Acceptable Use and User Conduct

When using Card Stash, you agree to conduct yourself in a respectful, lawful manner. Users who abuse the Site or violate these guidelines may be suspended or banned, and any offending content may be removed immediately. You agree NOT to engage in any of the following prohibited activities:

Inappropriate or Illegal Content/Behavior

Do not upload or share content that is illegal, hateful, harassing, defamatory, obscene, pornographic, or otherwise objectionable. Do not use the Site to engage in unlawful activities or to promote violence or discrimination. Users who post such content or engage in such behavior will be banned and their content removed.

Harassment and Abuse

Treat other users with respect. Do not threaten, bully, harass, or stalk anyone. Personal attacks, hate speech, or abusive language will not be tolerated.

Spam and Malicious Activity

Do not spam other users or post repetitive, irrelevant content. Do not use the Site to advertise unrelated products or services. Do not upload malicious code, viruses, or any other content that could harm the Site or other users' devices.

Impersonation and Fraud

Do not impersonate any person or entity or misrepresent your affiliation. Do not attempt to defraud, scam, or deceive other users. (Remember: Card Stash is not a marketplace; any trading or transactions you initiate are at your own risk and are not endorsed by the Site.)

Site Integrity

Do not attempt to interfere with the normal operation of Card Stash. This includes not attempting to hack the Site, avoiding any security measures, or disrupting the service (for example, by performing denial-of-service attacks, scraping content without permission, or using automated bots in a manner not allowed).

Compliance with Laws

You agree to comply with all applicable laws and regulations while using Card Stash. You are responsible for your own conduct and any content you post. You must not use Card Stash for any unlawful purpose, nor to violate any intellectual property or privacy rights of others.

Card Stash reserves the right to remove any content and to suspend or terminate any account that, in our judgment, violates the letter or spirit of these rules (see Termination below for more information). We also reserve the right to take appropriate legal action if necessary.

Messaging Policy

Card Stash offers an in-site messaging feature that allows users to communicate with each other. By using the messaging system, you agree to the following:

No Abuse of Messaging

You will not misuse or abuse the messaging feature. This means you must not send harassing, threatening, or spam messages to others. Any form of abuse, including unwanted solicitations or bullying via messages, is a violation of these Terms and may result in suspension or a ban of your account.

Limited Monitoring

Card Stash does not actively monitor all private messages, and we do not guarantee that we will catch violations that occur in private communications. However, we reserve the right to review messages if we receive reports of abuse or suspect violations of these Terms. We may take action, including removing messaging privileges or banning accounts, if we determine misuse has occurred.

Opt-Out/Blocking

Users have control over their messaging. If you do not wish to receive messages, you may disable or block incoming messages through your account settings (or an equivalent feature). It is your responsibility to utilize these features if you want to avoid unsolicited contact.

No Liability for User Messages

Card Stash is not liable for any content of user-to-user messages. Messages are intended for friendly communication and community engagement. We strongly discourage using the messaging system to arrange trades or sales of cards. Any such trading discussions or agreements are entirely at your own risk, and Card Stash will not mediate or be responsible for any loss or issues arising from private deals made between users. Always exercise caution and common sense when communicating with others.

Reporting

If you receive a message that violates these Terms or our guidelines (e.g., harassment, spam, scam attempts), please report it to the Site administrators. We will review reports and, if appropriate, we will warn, suspend, or ban the offending user.

Content Guidelines (User Submissions)

Card Stash allows users to upload images and descriptions of trading cards to share their collections. To maintain a focused and safe community, all user-submitted content must adhere to the following guidelines:

Allowed Content

Card Stash is dedicated to anime, fantasy, or cartoon trading cards and collectibles. Content you upload should be related to legitimate trading cards in these genres (e.g., images of Pokémon cards, Yu-Gi-Oh! cards, Magic: The Gathering, or similar fantasy/anime card games). Descriptions or commentary should likewise be relevant to the cards or collections being shown.

Moderation and Approval

All card image uploads are subject to moderation. We reserve the right to review, approve, or reject any content you submit. Newly uploaded content may require approval by a moderator before it becomes visible to others. If your upload is not relevant to the allowed genres or violates any guidelines, it will be rejected or removed.

Prohibited Content

Do not upload content that is unrelated to trading cards (for example, personal photos or other unrelated images) or any content that is inappropriate. Inappropriate content includes, but is not limited to, nudity/pornography, graphic violence, hateful imagery or symbols, excessively graphic or gruesome content, or any other material not suitable for a general audience. Such content will be removed. Additionally, any content that violates intellectual property rights or other rights (see Intellectual Property below) is not allowed.

No Personal or Confidential Info

Do not post personal data (like your full name, address, phone number, or anyone else's personal information) in card descriptions or anywhere public on the Site. Card descriptions and comments should be about the cards or collections, not personal details.

Quality and Authenticity

Upload only content you believe to be authentic and accurate. Do not knowingly upload counterfeit cards or misleading information. If you are providing information about a card, strive to keep it factual.

Repeated Violations

If you repeatedly upload disallowed content or otherwise violate these Content Guidelines, your account may be suspended or deleted. We will typically issue warnings for first-time or minor violations, but Card Stash reserves the right to suspend or terminate an account for any violation at any time (especially for serious violations).

By submitting content to Card Stash, you also agree that your content complies with both these Content Guidelines and the Acceptable Use rules above. We may remove any user content that, in our sole discretion, violates these Terms or is otherwise objectionable. We are not responsible for any failure or delay in removing such content.

Intellectual Property

We respect intellectual property rights and expect our users to do the same. This section explains how intellectual property is handled on Card Stash, both for user submissions and the Site's own content.

1. User Content and Copyright

When you upload an image or any content to Card Stash, you should either own the rights to that content or have the legal right to use it. In practice, users on Card Stash often upload images of trading cards that are produced by third-party publishers (for example, a card from a game or anime franchise). We understand that these card images may be protected by copyright or trademark held by the card publishers or artists. We believe that showing images of trading cards for non-commercial, personal collection display qualifies as fair use or fair dealing, since it is a transformative, informational use (displaying a card in the context of a personal collection or commentary) and is not done for profit. However, it is ultimately your responsibility to ensure that your uploads do not infringe on anyone's rights. By uploading content, you represent and warrant that you have the necessary rights or permissions to post that content, or that your use of the content is otherwise legally permitted (for example, under a fair use or similar exception).

2. License to Card Stash

By submitting or posting content on Card Stash, you grant Card Stash a worldwide, non-exclusive, royalty-free license to use, host, reproduce, display, and distribute your content on the Site for the purposes of operating and promoting the service. This license is necessary for us to display your card images and descriptions to other users. You retain any ownership of your content, and this license does not grant us the right to sell your content or otherwise use it outside of operating the Card Stash platform.

3. Fair Use and Takedowns

While we consider the use of trading card images on this Site to fall under fair use guidelines (e.g., limited, non-commercial display of the cards, without providing full-resolution artwork outside the card context), we are committed to respecting the rights of copyright and trademark owners. If you are a rights holder and believe that any user content on Card Stash infringes your copyrights, trademarks, or other intellectual property rights, please notify us via the Contact information below. We will promptly review such complaints and, if appropriate, remove the allegedly infringing content. Card Stash will respond to properly submitted takedown requests (for example, under the DMCA or applicable UK copyright law) and may remove content without prior notice to the user if the content is found to violate intellectual property rights.

4. Card Stash's Intellectual Property

The Card Stash website and service itself, including our logos, graphics, design, compilation of content, and all software and code that underlie the Site, are owned by Card Stash or our licensors and are protected by copyright, trademark, and other intellectual property laws. In summary, when you create an account on Card Stash, we ask for only a minimal amount of personal information: typically just a username, an email address, and a password to secure your account. We do not require your real name, address, or other sensitive details for you to enjoy the Site. Disclaimer of Warranties and Liability

Card Stash is provided on an "as is" and "as available" basis, without any warranties of any kind (either express or implied). While we strive to maintain a safe, functional service, we do not guarantee that the Site will be uninterrupted, error-free, secure, or that it will meet your expectations. To the fullest extent permitted by law, Card Stash disclaims all warranties, express or implied, including any implied warranties of title, accuracy, non-infringement, merchantability, or fitness for a particular purpose. Use of the Site and any content obtained through it is at your own risk.

Limitation of Liability

Under no circumstances will Card Stash or its owners, developers, or affiliates be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of (or inability to use) Card Stash. This includes, for example, any loss of data, loss of content you've posted, loss of goodwill, or damages for personal injuries or emotional distress arising from interactions with other users. In particular, Card Stash is not liable for any disputes or transactions between users, including any trades or sales of cards that users may attempt privately – remember, those are outside the scope of our service and at your own risk. We are not responsible for any offensive or illegal content posted by users; however, we do strive to moderate and remove violations when they are brought to our attention. Card Stash's total cumulative liability to you for any claims arising out of or relating to the service is limited to the amount (if any) you have paid us for the service in the 12 months immediately preceding the event that gave rise to the claim, or £100 GBP, whichever is less. Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the above may not apply to you. In such cases, Card Stash's liability will be limited to the maximum extent permitted by applicable law.

Indemnification

You agree that you will indemnify and hold harmless Card Stash and its affiliates, officers, agents, and employees from any claim, demand, losses, or damages, including reasonable legal fees, arising out of or related to your breach of these Terms, your unlawful conduct, or your violation of any rights of a third party (for example, if you upload content that infringes someone's copyright and they take action against us, you would be responsible for those costs).

Account Termination

Card Stash reserves the right to suspend or terminate your account at any time for violations of these Terms or for any other reason in our sole discretion. This can include abusive behavior, repeated content guideline violations, or any conduct we deem harmful to the community or the Site's operations. Termination may occur with or without prior notice. If your account is terminated, you may lose access to your collections, messages, and any other data associated with your account. We may also prohibit you from creating a new account or accessing the Site in the future. You are free to stop using Card Stash at any time and may delete your account if you wish. Our Privacy Policy explains what happens to your data when you delete your account (generally, we will delete personal data, though content you posted may remain if it was publicly shared, at our discretion or unless removed by us). If you believe your account was terminated in error, you may contact us to request a review. However, please note that we are not obligated to provide restoration of an account if we determine the termination was justified. The decision of Card Stash in these matters is final.

Governing Law

These Terms of Service and any dispute arising from your use of Card Stash are governed by and construed in accordance with the laws of England and Wales. By using the Site, you agree that any disputes or claims will be subject to the exclusive jurisdiction of the courts of England and Wales. We make no representation that the content or services on Card Stash are appropriate or available for use in other locations. If you access the Site from outside the United Kingdom, you do so on your own initiative and are responsible for compliance with any local laws.
